MyLinkz is a personal and brand bio-link creation service that allows users to consolidate and share their online presence. Our service is designed to simplify your audience's access to all of your content across the web.
1. Acceptance of Terms
Welcome to MyLinkz! By accessing and using our website (mylinkz.cc), associated applications, and services (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms") along with our Privacy Policy. If you do not agree to these terms, please do not use our services.
2. Changes to Terms
MyLinkz reserves the right to modify these Terms at any time. Changes will become effective immediately upon posting. Your continued use of our Service after changes have been posted will constitute your acceptance of such changes. If you do not agree to the new terms, you are free to discontinue using our services.
3. Account Requirements
To use MyLinkz, you must:
- Be at least 18 years old or have legal parental or guardian consent.
- Provide accurate and complete registration information.
- Keep your password secure.
- Be responsible for activity that occurs under your account.
If you are registering on behalf of a business or another individual, you represent that you are authorized to accept these terms on their behalf.
4. Content Ownership and Responsibility
You retain all rights in, and are solely responsible for, the content you post on MyLinkz. By posting content to our Service, you grant MyLinkz a non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, publish, transmit, display, and distribute such content in any and all media or distribution methods now known or later developed.
5. Prohibited Conduct
You agree not to engage in the following prohibited activities:
- Use of the Service for any unlawful purposes or for promotion of illegal activities.
- Posting any content that infringes the intellectual property rights or other rights of third parties.
- Attempting to interfere with, compromise the system integrity or security or decipher any transmissions to or from the servers running the Service.
- Taking any action that imposes, or may impose at our sole discretion an unreasonable or disproportionately large load on our infrastructure.
6. Termination
MyLinkz may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.
7. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. MyLinkz makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
8. Limitation of Liability
In no event shall MyLinkz, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.
10. Changes to Service
MyLinkz reserves the right to withdraw or amend the Service, and any service or material we provide via the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.
11. Acknowledgement
By using our Service, you acknowledge that you have read these Terms of Use and agree to be bound by them.
12. Free Service and Voluntary Support
All features of MyLinkz are currently free to use for normal personal and small-business use, under the fair use rules in section 13. We may change which features are free, introduce paid plans or change the Service in the future. If we do, we will tell you in advance on the website or by e-mail.
- Voluntary support: If you want, you can support MyLinkz with a voluntary contribution through Ko-fi (ko-fi.com/mylinkz). A contribution is a gift to support the Service. It is not a purchase and does not buy any feature, service level or right.
- Payment: Contributions are handled by Ko-fi and its payment providers, under their terms. We never see or store your card details.
- Thank-you perks: As a thank-you, Supporters get a Supporter badge and can show a heart on their page and appear on our public thank-you list. These are courtesy perks: we try to keep them, but they are not a promised service and can change.
- Refunds: Because contributions are voluntary, they are generally not refunded. If you made a mistake, for example paid the wrong amount, contact us within 14 days and we will help you.
- Earlier purchases: Gold bought before this change keeps the benefits it had, as far as they are still part of the Service, and those accounts are counted as Supporters.
Membership levels: Accounts start as Starter and reach Gold automatically when the page is set up (a profile picture, a confirmed e-mail and at least one item of content). Levels are free, show how complete an account is and may unlock some features. We may change the levels, their requirements and what they include, and we may remove a level from an account that breaks these Terms.
Business packages are agreed individually with each customer.
13. Fair Use, Heavy Traffic and Account Limits
MyLinkz is free for everyone because normal use costs us little. Each page and account is provided under fair use, so that the Service stays fast, reliable and affordable for everyone:
- Normal use: Unlimited links and normal visitor traffic for a personal page, creator or small business are included.
- Heavy traffic or usage: If a page or account uses far more server capacity, bandwidth or storage than normal use (as a guideline, more than about 50,000 page visits per month, heavy automated or bot traffic, or very large amounts of uploaded content), we may contact you and ask you to move to a Business package or pay a fee that covers the cost. We always try to find a solution that works for both of us.
- Commercial and campaign use: Pages used for paid advertising campaigns, large brands, agencies or many clients may need a Business package.
- Limits while we talk: If an account's usage affects the speed, stability or cost of the Service, we may limit it, for example by reducing features, slowing down or temporarily pausing the page, until a solution has been agreed.
- If no agreement is reached: If you don't reply within 14 days, or we can't agree on a solution, we may keep the limits or deactivate the page or account. Where reasonably possible we give notice first and let you export or move your content.
- Breaking these Terms: We may suspend or deactivate accounts that break these Terms or our policies, or that are used for spam, fraud, abuse or illegal content, without notice when needed.
- No unlimited capacity: A free account, a voluntary contribution or an earlier Gold payment does not include an obligation to provide unlimited capacity or traffic.
14. Content You Add to Your Page
You are responsible for everything you add to your page, including your title, bio, links, images, videos and the search title and description (SEO) of your page. These must not be misleading, offensive, sexual, hateful or illegal, and must not use other people's brands or names in a way that could confuse visitors. We check content automatically and by hand, and we may change, reset or remove content, or lock features such as the SEO fields, if it breaks these rules or harms MyLinkz or its users.
15. Advertising and Sponsored Content
To keep MyLinkz free for everyone, we may in the future show advertising or sponsored content in the Service, for example on our own pages, in the app or in limited, clearly marked places on public pages. We will always mark advertising and sponsored content clearly, we will not sell your personal data to advertisers, and any use of cookies or personal data for advertising will follow our Privacy Policy and Cookie Policy, including asking for your consent where the law requires it.
